8. Governing Law

8.1 Arbitration

The arbitration will take place in Denver, CO. The arbitrator's decision will follow the plain meaning of the relevant documents and will be final and binding. THIS ARBITRATION PROVISION CONSTITUTES A WAIVER OF ANY RIGHT TO A JURY TRIAL AND AN AGREEMENT TO BE SUBJECT TO JURISDICTION IN, AND CONDUCT ARBITRAL PROCEEDINGS IN COLORADO. Notwithstanding the foregoing provisions, either Party may seek a preliminary injunction or other provisional judicial remedy if in its judgment such action is necessary to avoid irreparable damage or to preserve the status quo, or as otherwise specified in this Agreement.
